Terms of Service

1. Agreement

These Terms of Service govern your use of the services and client portal provided by Windpixel Digital (“Windpixel”, “we”, “us”), an Australian business based in Perth, Western Australia. By creating an account or using our services, you agree to these terms.

2. Our services

Windpixel provides done-for-you local SEO, Google Business Profile management, AI visibility optimisation, advertising and related digital marketing services, delivered through our portal at my.windpixel.com.au. The specific services depend on the plan you subscribe to.

3. Accounts

You are responsible for the information you provide and for keeping your login secure. You must provide accurate business details and the access we need (for example, manager access to your Google Business Profile) so we can perform the services.

4. Changes and feedback (Pinpoint)

• All feedback and change requests for website, design and content work must be made through Pinpoint, the feedback tool on your preview site and in your portal. You click the spot you want changed and leave your note there.
• Feedback sent another way (email, text message, phone, chat, or a marked-up document or presentation) is not actioned until it is added to Pinpoint. We will always let you know and point you to the right place.
• Each Pinpoint note becomes its own tracked task, so you can see what is done, in progress or waiting on you, and nothing is lost between messages.
• Your proposal sets how many rounds of changes are included. A round starts when you submit it in Pinpoint. Changes outside the agreed scope, or beyond the included rounds, are quoted before any work starts.

5. Free trial, billing and cancellation

• Eligible plans include a free trial. A payment method is required to start, but you are not charged during the trial.
• If you do not cancel before the trial ends, your subscription begins and your card is charged the then-current monthly fee.
• Subscriptions are billed monthly in advance and renew automatically until cancelled.
• You can cancel anytime from the billing section of your portal; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.

6. Acceptable use

You agree not to misuse the service, attempt to disrupt it, or use it for unlawful purposes. You must own or be authorised to manage the business and accounts you connect.

7. Results disclaimer

Local SEO and advertising results depend on many factors outside our control, including Google’s algorithms and your market. We work diligently using best practices, but we do not guarantee specific rankings, traffic, leads or revenue. Any examples or illustrations of results are indicative only.

8. Third-party services

The service integrates with third parties such as Google, Meta (Facebook & Instagram), Stripe and GoHighLevel. Where we access advertising, analytics or CRM data through their APIs, including the Meta Marketing API and Google APIs, we do so only to deliver the services you have engaged us for and in accordance with those platforms’ terms and policies. Your use of those services is subject to their own terms, and we are not responsible for changes to, or the availability of, third-party platforms.

9. Intellectual property

We retain ownership of the portal, our software and our materials. You retain ownership of your business content and data. You grant us the limited rights needed to perform the services on your behalf.

10. Limitation of liability

To the maximum extent permitted by law, Windpixel is not liable for indirect or consequential loss. Our total liability for any claim is limited to the fees you paid in the three months before the claim. Nothing in these terms excludes rights you have under the Australian Consumer Law.

11. Termination

You may cancel at any time. We may suspend or terminate the service for breach of these terms or non-payment. On termination we stop providing the services and you can request export or deletion of your data.

12. Governing law

These terms are governed by the laws of Western Australia, Australia, and you submit to the courts of that jurisdiction.
